CINEMÁTICO TERMS OF USE

Last Updated: October 7, 2026

Welcome to Cinemático.

These Terms of Use (“Terms”) govern your access to and use of Cinemático, including cinematico.com, our mobile applications, and any related products, features, content, subscriptions, games, databases, and services that link to these Terms (collectively, the “Services”).

Cinemático is operated by MediaFan Group Inc., a Delaware corporation (“MediaFan,” “Cinemático,” “we,” “us,” or “our”).

By creating an account, purchasing a subscription, or accessing or using the Services, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not use the Services.

1. The Cinemático Service

Cinemático is a film-focused digital platform designed to help movie enthusiasts discover, understand, evaluate, and engage with movies and the broader world of cinema.

Depending on your location, account status, subscription level, and the features currently available, the Services may include:

Features may change, evolve, be added, removed, or become available only to certain users or subscribers.

2. Eligibility

You must be at least 13 years old to create an account or use account-based features of Cinemático.

If you are under the age of majority where you live, you may use the Services only with the permission of a parent or legal guardian.

By using the Services, you represent that you are legally capable of entering into these Terms or have the required authorization to do so.

3. Accounts

Some Cinemático features may be available without registration, while others require a registered account or paid subscription.

When creating an account, you agree to provide accurate information and keep your information reasonably current.

You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

You may not sell, transfer, license, or otherwise provide your Cinemático account to another person without our permission.

If you believe your account has been accessed without authorization, please contact us at support@cinematico.com.

4. Free, Registered, and Subscription Access

Cinemático may offer different levels of access to the Services.

Certain content or functionality may be available to visitors without registration. Additional features may require registration, and premium content or functionality may require a paid subscription.

Cinemático may establish or modify:

The availability of particular features or content at one time does not guarantee that those features or content will remain available under the same access level in the future.

We will not retroactively charge you for previously free use without your authorization.

5. Subscriptions

Cinemático may offer monthly, annual, multi-year, promotional, trial, or other subscription plans.

The applicable price, subscription period, included benefits, and billing terms will be disclosed when you subscribe.

By purchasing a subscription, you authorize the applicable payment provider to charge the disclosed subscription price and applicable taxes using your selected payment method.

Unless otherwise stated at purchase, subscriptions automatically renew at the end of each billing period until canceled.

You may cancel your subscription at any time through the platform through which you purchased it or through other cancellation methods we make available.

Cancellation generally becomes effective at the end of the current paid billing period. You will ordinarily retain subscription access until that period expires.

Deleting the Cinemático application does not necessarily cancel a subscription.

6. Pricing and Changes

Cinemático may change subscription prices, plans, or included benefits from time to time.

Price changes affecting an existing recurring subscription will be communicated and implemented in accordance with applicable law and the requirements of the payment platform through which the subscription was purchased.

We may introduce new subscription levels, promotional pricing, bundles, or other commercial offerings.

7. Trials and Promotions

Cinemático may offer free trials, introductory pricing, promotional access, discount codes, or similar offers.

Eligibility and terms may vary and may be limited to certain users, locations, or periods.

Unless otherwise disclosed, a trial that converts to a paid subscription may automatically begin billing when the trial ends unless canceled before the applicable deadline.

The specific terms presented when you enroll in an offer control that offer.

8. Payments and Refunds

Payments may be processed by third-party providers, including Apple, Google, or other payment processors.

Purchases made through an app store are also subject to the applicable app store’s payment and refund policies.

Except where otherwise required by law, stated at the time of purchase, or provided under an applicable platform’s policies, payments are generally non-refundable after the applicable paid subscription period has begun.

Nothing in these Terms limits any refund, cancellation, or consumer rights that cannot legally be waived.

9. Ratings, Reviews, Comments, Lists, and Other User Content

Cinemático may allow users to submit or create ratings, reviews, comments, lists, profile information, votes, images, text, or other materials (“User Content”).

You retain ownership of User Content that you create.

By submitting User Content to Cinemático, you grant MediaFan Group Inc. a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, display, distribute, communicate, modify, format, adapt, and otherwise use that User Content as reasonably necessary to operate, promote, improve, and provide the Services.

This license also allows us to use User Content in connection with Cinemático features such as aggregate audience ratings, recommendations, rankings, trends, discovery tools, promotional materials, and analytical products.

You represent that you have the rights necessary to submit your User Content and that its use by Cinemático as permitted under these Terms will not violate the rights of another person.

You remain responsible for your User Content.

10. Public Content

Certain User Content may be publicly visible.

Your username, profile information, ratings, reviews, comments, lists, or other contributions may therefore be visible to other users or the public depending on the feature and your settings.

Do not publish information that you do not want others to see.

11. Content Standards and Community Conduct

You may not use Cinemático to post, transmit, promote, or distribute content that:

Cinemático may establish additional Community Guidelines as the Services evolve.

We may moderate, restrict, remove, or disable access to User Content when we reasonably believe it violates these Terms, our policies, applicable law, or the rights or safety of others.

12. Ratings and Audience Scores

Ratings, reviews, Movie Pulse™, audience scores, rankings, trends, and similar metrics represent opinions, calculations, or aggregated user activity.

They should not be interpreted as objective statements of fact.

Cinemático may establish reasonable methodologies, minimum participation thresholds, anti-manipulation systems, weighting mechanisms, or other rules governing how ratings and audience metrics are calculated and displayed.

We may modify these methodologies as the Services evolve.

13. Cinemático Intellectual Property

The Services and the materials made available through them (including software, designs, interfaces, graphics, databases, editorial content, data structures, methodologies, features, logos, trademarks, audiovisual materials, and other content created or owned by Cinemático) are owned by or licensed to MediaFan Group Inc. and are protected by applicable intellectual property laws.

This includes, where applicable, proprietary Cinemático products and features such as:

and other Cinemático technologies, methodologies, products, brands, and features.

Except as expressly permitted by these Terms, you may not copy, reproduce, republish, distribute, sell, license, modify, create derivative works from, publicly display, commercially exploit, or otherwise use Cinemático’s proprietary content or technology without our permission.

14. Limited License to Use Cinemático

Subject to these Terms, Cinemático grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.

This license does not give you ownership of any Cinemático content, software, database, feature, methodology, or intellectual property.

15. Automated Access, Scraping, and Data Extraction

Unless expressly authorized by Cinemático in writing, you may not:

This restriction does not prohibit ordinary indexing by generally recognized public search engines where authorized by our technical settings.

16. Third-Party Content and Film Information

Cinemático may display information obtained from third-party sources, licensors, public sources, APIs, or databases.

Film metadata, images, credits, release information, awards information, trailers, links, and similar materials may therefore originate from third parties.

Such materials remain subject to the rights of their respective owners.

Cinemático does not claim ownership of third-party intellectual property merely because it appears within the Services.

Third-party content may occasionally contain errors, omissions, delays, or outdated information. While we seek to provide a high-quality service, we do not guarantee that all third-party information will always be complete or accurate.

17. Editorial Content

Cinemático may publish reviews, analysis, articles, recommendations, rankings, predictions, commentary, and other editorial materials.

Such materials may express opinions and are provided for informational and entertainment purposes.

Editorial judgments belong to Cinemático or the identified author and should not be interpreted as statements by film studios, distributors, filmmakers, performers, festivals, awards organizations, or other third parties unless expressly stated.

18. Artificial Intelligence and Automated Features

Cinemático may use artificial intelligence, machine learning, recommendation systems, algorithms, or other automated technologies in connection with features such as discovery, personalization, search, classification, analysis, recommendations, or editorial tools.

Outputs generated or assisted by automated technologies may contain errors or produce unexpected results.

Cinemático may modify the technologies and methodologies underlying these features as the Services evolve.

19. Games and Interactive Features

Cinemático may provide games, quizzes, predictions, challenges, leaderboards, or other interactive experiences.

Unless expressly stated otherwise, these features are provided for entertainment purposes and do not involve wagering or gambling for money.

Rules or eligibility requirements applicable to a particular game, contest, promotion, or competition may be provided separately and will govern that activity.

20. Copyright Complaints

Cinemático respects intellectual property rights.

If you believe content available through the Services infringes your copyright, you may contact us at:

legal@cinematico.com

Your notice should identify the copyrighted work, the allegedly infringing material, sufficient information for us to locate the material, your contact information, and other information reasonably required to evaluate the claim.

We may remove or restrict access to content when appropriate.

21. Feedback

We welcome ideas, suggestions, comments, and other feedback about Cinemático.

If you voluntarily provide feedback regarding our products or Services, you agree that we may use that feedback without restriction or compensation to you.

This does not transfer ownership of your User Content to Cinemático.

22. Prohibited Uses

You may not:

23. Suspension and Termination

You may stop using Cinemático at any time.

You may also request account deletion through functionality we make available or by contacting us.

We may suspend, restrict, or terminate an account when reasonably necessary, including for:

Where appropriate, we may provide notice or an opportunity to address the issue.

Termination does not eliminate obligations or provisions that by their nature should survive termination.

24. Changes to the Services

Cinemático is an evolving product.

We may modify, add, remove, discontinue, test, or redesign features or content.

We do not guarantee that any particular feature, title, database entry, article, game, or functionality will remain permanently available.

Where a material change affects a paid subscription, we will comply with applicable consumer-protection requirements.

25. Service Availability

We work to maintain reliable access to Cinemático, but we cannot guarantee uninterrupted or error-free operation.

The Services may occasionally be unavailable because of maintenance, updates, technical failures, third-party services, security issues, events outside our reasonable control, or other circumstances.

26. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available.”

MediaFan Group Inc. makes no guarantee that the Services will always be uninterrupted, error-free, secure, or completely accurate.

We disclaim warranties to the extent legally permitted, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

27. Limitation of Liability

To the fullest extent permitted by applicable law, MediaFan Group Inc. and its directors, officers, employees, contractors, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Services.

To the fullest extent permitted by law, MediaFan Group Inc.’s aggregate liability arising from the Services or these Terms will not exceed the greater of:

(a) the amount you paid to Cinemático during the twelve months preceding the event giving rise to the claim; or
(b) US$100.

These limitations do not apply where liability cannot legally be limited or excluded.

28. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless MediaFan Group Inc. and its officers, directors, employees, and agents from claims, damages, liabilities, and reasonable costs arising from:

29. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Nothing in these Terms deprives you of mandatory protections provided by the laws of your jurisdiction.

30. Disputes

Before initiating formal legal proceedings, you and MediaFan Group Inc. agree to make a reasonable good-faith effort to resolve disputes informally.

You may initiate that process by contacting:

legal@cinematico.com

and describing the nature of the dispute and the relief requested.

If the dispute cannot be resolved informally, either party may pursue available legal remedies, subject to applicable law.

31. Changes to These Terms

We may update these Terms as Cinemático evolves or as legal requirements change.

When we do, we will update the “Last Updated” date.

For material changes, we may provide additional notice through the Services, by email, or through another reasonable method.

Continued use of the Services after revised Terms become effective constitutes acceptance to the extent permitted by applicable law.

If applicable law requires affirmative consent to a change, we will request it.

32. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

You may not assign your rights or obligations under these Terms without our consent. MediaFan Group Inc. may assign these Terms in connection with a merger, acquisition, restructuring, financing, sale of assets, or similar corporate transaction.

These Terms, together with the Privacy Policy and any additional terms expressly applicable to a particular Cinemático product or promotion, constitute the agreement between you and MediaFan Group Inc. regarding your use of the Services.
